The Annual Report 2012 contains some case studies which demonstrate the role of the Data Protection Commissioner and the importance of compliance with data protection legislation.

Case Study 12 provides details of a number of prosecutions for unsolicited marketing, primarily unsolicited text messages that the data protection commissioner took to the district court for breach of data protection legislation and outlines the consequences for the parties involved.

Guidance is available on the Data Protection Commissioner’s website on the data protection rules that must be considered when engaging in direct marketing.
